1. Definition
The following words or expressions shall mean the following:
"Animal" means any livestock including but not limited to dogs, cats, birds, hamsters, rabbits and mice.
"Buyer" means the person who buys or agrees to buy the Animal from the Seller or otherwise the person whose name and address appears next to the box marked "Buyer".
"Price" means the price for the Animal indicated on the receipt and as further defined in clause 2 below.
"Seller" means the person selling the Animal for the Price to the Buyer.
2. Price
The price for the Animal shall exclude any good and service tax or other taxes, levies or fees.
The price for the Animal and other charges indicated in the Seller’s Sale of Animal Form is due and payable upon the signing of the Sale of Animal Form or upon the Buyer taking delivery of the Animal, whichever is earlier. The Seller is entitled to withhold delivery of the Animal to the Buyer unless the Price is paid.
In the event that the Seller allows the Buyer to pay the Price by way of installments, interest of 1.5% per month is chargeable at the sole discretion of the Seller.
In the event the Buyer defaults in any installment payment, the Price or any outstanding or balance of the Price including the foresaid interest is due and immediately payable by the Buyer to the Seller on demand without set-off or counterclaim for any reason whatsoever.
3. Title of the Animal
The Seller warrants that he or she has good title to the Animal.
4. Description and Fitness of Purpose of the Animal
The Seller does not represent nor warrant the accuracy of any description of the Animal including but not limited to any description concerning the age, colour, sex and health of the Animal.
The sale of Animal to the Buyer shall not be invalidated by any reason of misdescription of the Animal and no compensation is to be paid in respect of any such faults or errors of description.
The Seller makes no representation nor gives any warranty of the fitness of the Animal for any purpose whatsoever.
5. Property and Risk of the Animal
Property and risk of the Animal passes upon the Buyer signing the Seller’s Sale of Animal Form or upon the Buyer taking delivery of the Animal whichever is earlier notwithstanding that at the request of the Buyer, the Animal is to be delivered by the Seller to the Buyer at a later date.
6. Inherent defect/Virus/Bacteria/Guarantee
The Buyer purchases the Animal at his own choice and therefore, at his own risk. The Buyer agrees that he or she has not relied on any representation made by the Seller. Without prejudice to the aforesaid and subject to the terms set out hereunder, the Seller guarantees that should the Animal contract a viral or bacterial infection within 24 hours from the date Buyer signs the Sales of Animal Form or upon delivery of the Animal to the Buyer, whichever is earlier, the Seller will refund the Price to the Buyer subject to the following condition precedents:
The Buyer furnishes to the Seller a report of the Animal duly prepared and certified by a qualified veterinarian at the Buyer’s cost indicating that the viral or bacterial infection contracted by the Animal within 24 hours from the date the Buyer signs the Sales of Animal Form or upon delivery of the Animal to the Buyer, whichever is earlier, and the foresaid report is to be furnished to the Seller within 24 hours from the date the Buyer signs the Sale of Animal Form or upon delivery of the Animal to the Buyer, whichever is earlier,

In the event of the death of the Animal, a post-mortem report shall be furnished, at the Buyer’s costs, to the Seller within 28 days from the date the Buyer signs the Sales of Animal Form or upon delivery of the Animal to the Buyer, whichever is earlier. The post-mortem report shall describe and identify the Animal and shall also confirm that the death of the Animal was solely caused by a viral or bacterial infection. The refund of the Price to the buyer is in full and final settlement of the Buyer’s claim against the Seller including but not limited to all consequential loss and damage the Buyer may suffer arising from the viral or bacterial infection or death of the Animal.
7. Indemnity
In the event the Seller is entitled to enforce the terms and conditions set out herein against the Buyer, the Buyer shall indemnify the Seller of all its losses and damage arising from the Buyer’s non-compliance with any o the terms and conditions herein including but not limited to all legal cost and disbursements on the indemnity basis.
8. Goodwill gesture compensation
In the event of any dispute between the Seller and the Buyer, at the sole discretion of the Seller, the Seller may offer to the Buyer a sum of SGD 200.00 as compensation for the Buyer’s grievance and upon the Seller rendering to the Buyer its cheque or cashier’s order of SGD $200.00 in favor of the Buyer, the Buyer shall have no further claims against the Seller whatsoever.
9. Acceptance
The Buyer agrees that upon signing the Seller’s Sale of Animal Form, the Buyer accept the terms and conditions herein without reservation or qualification whatsoever.
